TERMS OF SERVICE

1. ABOUT THESE TERMS

This website is operated by Folded Marketing Pty Ltd (ABN 44 689 619 065) under the Robe Swim brand.

Throughout these Terms of Service, “Robe Swim”, “we”, “us” and “our” refer to Folded Marketing Pty Ltd.

These Terms of Service govern your access to and use of our website, online store, content, products and related services.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and any policies referred to within them, including our:

  • Returns and Store Credit Policy

  • Shipping and Delivery Policy

  • Privacy Policy

  • Purchase Options Cancellation Policy

If you do not agree to these Terms, you should not use our website or purchase products from us.

Our online store is hosted by Shopify, which provides the ecommerce platform through which we sell our products.

2. ELIGIBILITY

By placing an order, you confirm that:

  • You are at least 18 years old or have the permission of a parent or legal guardian

  • You are legally capable of entering into a binding agreement

  • The information you provide is accurate and complete

  • You are authorised to use the payment method supplied

  • Your purchase is for lawful purposes

You must not use our products, website or services for any illegal, fraudulent or unauthorised purpose.

3. PRODUCT INFORMATION

We take reasonable care to ensure product descriptions, photographs, measurements, prices and availability are accurate.

However:

  • Colours may appear slightly different depending on lighting, photography and individual screen settings

  • Placement of prints, patterns and decorative details may vary between individual pieces

  • Measurements are approximate

  • Product availability may change without notice

  • Packaging may change from time to time

These minor variations do not necessarily constitute a product fault unless the product is materially different from its description.

You are responsible for reviewing the product description, sizing information, care instructions and any other relevant details before purchasing.

4. PRICES AND PAYMENT

Prices are displayed in the currency shown on the website or at checkout. Australian prices include GST where applicable unless otherwise stated.

International customers may be shown prices in a local currency. The final currency, price, shipping charges and applicable taxes will be displayed before payment is completed.

You agree to pay:

  • The price displayed at checkout

  • Applicable shipping charges

  • Any taxes or charges shown at checkout

  • Any international duties, import taxes or customs charges imposed by the destination country

Payment must be successfully authorised before an order can be accepted.

We may use third-party payment processors. Your use of those payment services may also be subject to the provider’s terms and privacy practices.

5. ORDERS AND ORDER ACCEPTANCE

Submitting an order and receiving an automated confirmation does not necessarily mean that we have accepted the order. The confirmation acknowledges that we have received your order request.

An order is accepted when it has been reviewed and enters fulfilment or is dispatched.

We may decline, limit or cancel an order where reasonably necessary, including where:

  • A product is unavailable

  • Incorrect pricing or product information has been displayed

  • Payment cannot be authorised

  • Fraudulent, suspicious or unauthorised activity is identified

  • An order appears to be placed for unauthorised resale

  • Shipping restrictions prevent us from fulfilling the order

  • A technical or inventory error has occurred

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

We will attempt to contact you using the details provided with your order if a change or cancellation is required.

6. CUSTOMER CANCELLATIONS AND ORDER CHANGES

We begin preparing orders quickly. Once an order has entered processing, we cannot guarantee that it can be changed or cancelled.

If you need to correct your address, change an item or request cancellation, contact hello@robeswim.au as soon as possible.

An order is not changed or cancelled until you receive written confirmation from Robe Swim.

Once an order has been dispatched, it cannot be cancelled. Any eligible return will be handled under our Returns and Store Credit Policy.

Purchase options such as subscriptions, recurring purchases and pre-orders are also subject to our Purchase Options Cancellation Policy.

7. PROMOTIONS AND DISCOUNT CODES

Promotions, discount codes and special offers:

  • Are subject to their advertised conditions

  • Must be used before their stated expiry date

  • Cannot be redeemed for cash

  • Cannot be applied retrospectively

  • Cannot be combined unless expressly permitted

  • May be limited to certain products, customers or purchase amounts

  • May be withdrawn or corrected where a genuine error has occurred

Only one discount code may be used per order unless otherwise stated.

Products purchased using a discount or promotional code may be excluded from change-of-mind returns as set out in our Returns and Store Credit Policy. This does not affect any rights available under Australian Consumer Law.

We may cancel or refuse a discount obtained through misuse, unauthorised distribution, technical manipulation, fraud or breach of the promotion’s terms.

8. GIFT CARDS AND STORE CREDIT

Gift cards and store credit:

  • Cannot be exchanged for cash

  • Must be used through the Robe Swim store

  • Cannot be replaced if used without authorisation, except where required by law

  • May be subject to additional conditions disclosed when issued

Any expiry period applying to a gift card will comply with Australian law.

Store credit issued for a return reflects the amount actually paid for the eligible returned item and does not include original shipping charges unless otherwise required by law.

9. SHIPPING AND DELIVERY

Orders are shipped in accordance with our Shipping and Delivery Policy.

Delivery timeframes are estimates and are not guaranteed. Delivery may be affected by:

  • Carrier disruptions

  • Customs processing

  • Peak trading periods

  • Public holidays

  • Severe weather

  • Incorrect delivery information

  • Circumstances outside our reasonable control

You are responsible for providing a complete and accurate delivery address.

If authority to leave, safe drop or another unattended delivery instruction is selected, the parcel may be left in accordance with that instruction. Subject to Australian Consumer Law, Robe Swim cannot accept responsibility for theft or loss occurring after the carrier has confirmed delivery to the nominated address.

If your order is delayed or tracking has not updated for an extended period, contact hello@robeswim.au so we can assist with a carrier enquiry.

10. INTERNATIONAL ORDERS

International orders may be subject to customs processing, import duties, taxes or other government charges.

These charges:

  • Are determined by the destination country

  • Are not controlled or collected by Robe Swim unless shown at checkout

  • Remain the customer’s responsibility

We cannot lower the declared value of an international shipment or declare an order as a gift.

If an international parcel is refused or returned because duties or taxes were not paid, reasonable return charges and other carrier costs may be deducted from any amount otherwise refundable, to the extent permitted by law.

11. RETURNS, STORE CREDIT AND FAULTY PRODUCTS

Change-of-mind returns are governed by our Returns and Store Credit Policy.

Eligible full-priced products may be returned for store credit where all return conditions are satisfied.

Sale products, final-sale products and products purchased using promotional or discount codes may be excluded from change-of-mind returns.

Nothing in these Terms excludes or limits your rights where a product is faulty, damaged, incorrectly supplied or otherwise fails to comply with Australian Consumer Law.

12. AUSTRALIAN CONSUMER LAW

Our products and services come with guarantees that cannot be excluded under Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation where a product or service fails to meet an applicable consumer guarantee.

Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee or remedy that cannot legally be excluded.

Any exclusions or limitations in these Terms apply only to the maximum extent permitted by law.

13. PRODUCT CARE AND USE

You are responsible for following the care instructions provided with the product or displayed on our website.

Robe Swim is not responsible for damage caused by:

  • Failure to follow care instructions

  • Contact with rough or abrasive surfaces

  • Incorrect washing, drying or storage

  • Exposure to harsh chemicals, bleach, oils or excessive heat

  • Misuse, neglect or accidental damage

  • Normal wear and tear

This section does not limit your rights where damage results from a manufacturing fault or other failure to comply with Australian Consumer Law.

14. CUSTOMER ACCOUNTS

You may be able to create an account through our website.

You are responsible for:

  • Keeping your login information confidential

  • Restricting access to your account

  • Providing accurate account information

  • Notifying us promptly of suspected unauthorised use

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms.

15. INTELLECTUAL PROPERTY

All content displayed through Robe Swim, including:

  • Photographs

  • Videos

  • Product designs

  • Graphics

  • Logos

  • Branding

  • Written copy

  • Website layouts

  • Illustrations

  • Campaign materials

is owned by or licensed to Folded Marketing Pty Ltd and is protected by applicable intellectual property laws.

You may view and use our website for personal, non-commercial shopping purposes.

You must not copy, reproduce, republish, distribute, modify, sell, exploit or use our content for commercial purposes without our prior written permission.

16. REVIEWS, PHOTOGRAPHS AND USER CONTENT

If you submit a review, photograph, comment, competition entry or other content to Robe Swim, you confirm that:

  • You created the content or have permission to submit it

  • The content is accurate and not misleading

  • It does not infringe another person’s rights

  • It is not unlawful, defamatory, abusive or offensive

  • It does not contain malicious software or unauthorised advertising

You grant Folded Marketing Pty Ltd a non-exclusive, worldwide, royalty-free licence to display, reproduce and use content that you voluntarily submit to us for operating and promoting Robe Swim.

We will not knowingly publish personal information beyond what you have authorised.

We may remove or decline content that breaches these Terms.

17. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to or integrations with third-party services, including payment providers, social platforms, review services, marketing platforms and delivery providers.

Third-party services operate under their own terms and privacy policies.

We are not responsible for third-party websites or services that we do not control. You should review their terms before using them.

Nothing in this section limits our responsibility for services we are legally responsible for providing.

18. PRIVACY

Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

By using our website or placing an order, you acknowledge that your information may be processed by service providers involved in operating the store, processing payments, delivering orders, preventing fraud and communicating with you.

Marketing communications will only be sent in accordance with applicable laws, and you may unsubscribe using the link provided in the communication.

19. WEBSITE AVAILABILITY

We aim to keep the website accurate, secure and available. However, we cannot guarantee uninterrupted or error-free access.

The website may occasionally be unavailable because of maintenance, updates, technical issues, third-party disruptions or circumstances outside our reasonable control.

We may update, suspend or discontinue parts of the website where reasonably necessary.

20. ERRORS AND INACCURACIES

Occasionally, the website may contain a genuine error relating to:

  • Pricing

  • Product descriptions

  • Promotions

  • Shipping charges

  • Availability

  • Delivery estimates

  • Images or measurements

We may correct genuine errors and update affected information.

If an error materially affects an order you have placed, we will contact you and offer an appropriate correction, alternative or refund.

We will not use this section to avoid an order merely because it has become commercially inconvenient to fulfil.

22. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Folded Marketing Pty Ltd is not liable for indirect or consequential loss arising from:

  • Misuse of the website or products

  • Unauthorised access caused by a customer’s failure to protect their account

  • Third-party services outside our reasonable control

  • Events outside our reasonable control

Where our liability can lawfully be limited, it will be limited to the remedy required under applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising under Australian Consumer Law.

23. INDEMNITY

To the extent permitted by law, you agree to indemnify Folded Marketing Pty Ltd against reasonable loss, liability or expense arising directly from:

  • Your unlawful use of the website

  • Your material breach of these Terms

  • Your infringement of another person’s intellectual property or legal rights

  • Fraudulent or deliberately misleading conduct by you

This indemnity does not apply to loss caused by our own negligence, unlawful conduct or breach of these Terms.

24. SUSPENSION AND TERMINATION

You may stop using our website at any time.

We may suspend or terminate access where we reasonably believe that a user has:

  • Breached these Terms

  • Engaged in fraud or unlawful activity

  • Misused the website

  • Threatened the security or operation of the website

  • Infringed another person’s rights

Termination does not affect any rights or obligations that arose before termination.

25. CHANGES TO THESE TERMS

We may update these Terms when our business, services, systems or legal obligations change.

The current version will be published on this page with an updated effective date.

Changes will apply from the date they are published and will not retrospectively alter an order already accepted unless required by law or agreed with you.

Your continued use of the website after updated Terms are published constitutes acceptance of the updated Terms for future use.

26. SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed only to the extent necessary.

The remaining Terms will continue to operate.

27. NO WAIVER

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

28. ENTIRE AGREEMENT

These Terms, together with the policies referred to within them, form the agreement between you and Folded Marketing Pty Ltd regarding your use of Robe Swim and purchases made through the website.

They replace any previous version of the website Terms of Service.

29. GOVERNING LAW

These Terms are governed by the laws of Queensland and the Commonwealth of Australia.

The parties submit to the courts with jurisdiction in Queensland, subject to any rights a consumer may have to bring a claim in another jurisdiction.
